These Terms of Service ("Terms") govern your access to and use of PropertyShield+ (the "Services") offered by PropertyShield+ ("we", "us", "our"). By creating an account or using the Services you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 and able to enter into a binding contract. You are responsible for activity on your account and for keeping your credentials secure. Notify us immediately of any unauthorized use.
2. Subscriptions, billing, and renewals
- Paid plans are billed in advance on a monthly or annual basis through Stripe.
- Subscriptions renew automatically until cancelled in your dashboard.
- Annual plans receive a posted discount, applied at checkout.
- Except where required by law, fees are non-refundable. Refunds and credits are issued at our discretion.
- Failed payments may result in suspension of monitoring features after a grace period.
3. Plan limits and feature gating
Each plan includes a stated number of monitored properties and feature set (alert cadence, advanced documents, family sharing). Exceeding plan limits requires an upgrade.
4. Acceptable use
- No unlawful, fraudulent, infringing, or harmful use of the Services.
- No scraping, reverse-engineering, or circumventing security or rate limits.
- No misuse of public records or attempts to monitor properties you do not own or are not authorized to monitor.
- No abusive content in reviews, support requests, or referrals.
5. Service scope and geographic coverage
PropertyShield+ monitors publicly available U.S. property records only — all 50 states, Washington D.C., and U.S. territories where county recorder and assessor offices publish digital land records (approximately 3,100+ counties). Data cadence, completeness, and freshness vary by county and by third-party provider. We do not currently monitor properties located outside the United States, and any property address you submit for monitoring must be a U.S. address.
The Services are informational and do not constitute, and are not a substitute for, legal, tax, title, real estate, insurance, financial, or law-enforcement advice or services. PropertyShield+ does not provide title insurance, title search or curative services, deed preparation or filing, notarization, legal representation, dispute resolution, fraud investigation, fraud recovery, funds recovery, reimbursement for losses, identity theft remediation, credit monitoring, or any government function. We do not guarantee that monitoring will detect every filing, that alerts will arrive within any specific timeframe, or that any fraud or unauthorized activity will be prevented, detected, or reversed. You remain solely responsible for reviewing alerts, verifying record activity with the applicable county, and engaging licensed professionals (attorneys, title companies, law enforcement) when needed.
6. Referral and affiliate program
Referral credits and affiliate payouts are subject to program rules. We may adjust, withhold, or claw back credits in cases of fraud, refunds, chargebacks, or terms violations.
7. Intellectual property
We retain all rights in the Services, branding, and content we provide. You retain rights to content you submit and grant us a license to host, display, and process it to operate the Services.
8. Termination
You may cancel at any time from your dashboard. We may suspend or terminate accounts that violate these Terms or pose risk to the Services. Upon termination, access to paid features ends at the end of the current billing period.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE FRAUD PREVENTION, DETECTION, OR RECOVERY.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Services or violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless required otherwise by applicable consumer law.
13. Changes
We may update these Terms; material changes will be communicated through the Services or by email.
